Chip’s B2B Tip #93 - MP3 Usage Legal?
.
B2B Tip #93 - You decide About MP3
.
I have not researched the following, and offer no opinions on its veracity or lack thereof.
I just downloaded and read a report from From Joe E. Clayton, Jr. and Joe Robson concernng the current mp3 usage of a lot of people being legal or not ...
MP3 is an acronym for MPEG-1 Layer III.
You can look at this site if you wish:
http://www.mp3licensing.com
Clayton and Robson purport in this report that the distribution and/or use of MP3 files for ANY commercial purpose requires that you obtain a license from and pay the appropriate royalty fees to the patent holders Fraunhofer/Thomson.
(NOTE: Although Thomson is a patent holder, since 1993, they have also been the exclusive Licensor of the Fraunhofer/Thomson patented technology.)
Possible Alternatives?
Xiph is a collection of Open Source Projects. Open Source projects are, by definition "free" and NOT subject to patents and license fees. The Open Source Project can be found at http://www.opensource.org/. One of the oldest and most aggressive Xiph projects to date has been the "Ogg Project".
Simply put, Ogg is another format for audio files.
WizardofOgg
The software is legally licensed: it is licensed to redistribute the Microsoft Media 9 / DirectX technology, which it uses to convert your audio. It is available here: http://www.WizardofOgg.com
