I just downloaded and read a report from From Joe E. Clayton, Jr. and Joe Robson concernng the current mp3 usage of a lot of people being legal or not ...

MP3 is an acronym for MPEG-1 Layer III.

Clayton and Robson purport in this report that the distribution and/or use of MP3 files for ANY commercial purpose requires that you obtain a license from and pay the appropriate royalty fees to the patent holders Fraunhofer/Thomson.

(NOTE: Although Thomson is a patent holder, since 1993, they have also been the exclusive Licensor of the Fraunhofer/Thomson patented technology.)

Possible Alternatives?

Xiph is a collection of Open Source Projects. Open Source projects are, by definition "free" and NOT subject to patents and license fees. The Open Source Project can be found at http://www.opensource.org/. One of the oldest and most aggressive Xiph projects to date has been the "Ogg Project".

My friend, Paul Myers of http://www.talkbiz.com fame sent me an email newsletter today in which he addresses a question from a person named Zoran on one of the online discussion forums.

Zoran apparently is looking for a business to start, and Paul makes certain definitive suggestions (in his usual Paul-style). As is typical with Paul sharing his wisdom, it's surely worth sharing with you.

In fact, you would be well served to go get on Paul's list.

If you're not careful, you'll pay big bucks for crappy information from other people that's not nearly as effective, efficient, and doable as what Paul gives you here for free.

Here's something I haven't seen many people discuss. You can start it very inexpensively, and it's got as much potential as almost anything you could do online, if you work at it.

LOCAL advertising, on a strictly opt-in basis.

Start a site that caters to your area. Let's say, for example, that you live in Toronto. Register TorontoNites.com, which is available as I write this.

Get a copy of phpList from http://www.phplist.com/

Set it up with various categories of things people might want to hear specials and notifications about. Some examples:

-> Dinner specials
-> Theatre and movie specials
-> Music happenings (concerts, local bands, etc):
Jazz
Blues
Country
Classical
Alternative
Rock
-> Civic events
-> Outdoor happenings
-> Art fairs and exhibitions
-> Home improvement
-> Gardening
-> Etc...

When people sign up, they will be able to check the areas they want to hear about. In addition to their preferences, you'll want to get their first name, email address and zip code.

Because it's local, I recommend that you consider very carefully before asking for a last name. That may make some people uncomfortable. If you ask, make sure it's optional and that the subscriber knows it.

Make sure the program is set to require confirmations and make the process clear on the page that comes up after they hit the "Subscribe" button.

Now, get some good photos of things happening in the city. Stuff that's fun and interesting and clearly local. Put together a simple, clean looking site that exists for one purpose: To let people sign up to be notified of entertainment, educational and civic events that fit their interests.

To get the ball rolling, you first want to approach some of the non-profit, educational and artistic institutions in town and offer to let your subscribers know about their events - free.

Place a link on a separate page (linked from the front page) to those sites. Mention that and let them know that you would welcome a link back if they feel it would be appropriate.

Also, trade links with other local sites. A directory of Toronto web sites would be a good addition for your members, and provides a good introduction to potential link partners.

You're developing content sources AND traffic sources at the same time.

Next, publicize the site in the local papers and see about getting other press. Get creative with this, but try the news angle first. Remember: Subscriptions are free.

Put up a link on the front page mentioning your advertising options. It should be easy to find, but not something most people will notice unless they're looking for it. Something at the bottom saying "Advertise in Toronto Nites" would be about right.

Once you have 1000 or more subscribers, start looking for local restaurants or other businesses and offer the first ones free ad space (or solo ads), to test the responsiveness of the medium for them.

When it gets going, you'll find it very easy to get advertisers. You keep the whole thing useful by only sending the ads to people who asked for info on those topics. phpList s very cool in this regard... And they can change their preferences at any time, too.

Keep sending those notices of civic events of interest, like art fairs and free concerts. Make it useful, and the word will spread. People will pass those emails along to friends and that can mean a lot of subscribers.

That's money model number one: Paid advertising to people who've asked for it, and told you exactly what they want to hear about. That's OUTSIDE the "locked" section of the site.

Next, set up blogging software that let's you create multiple blogs with different passwords.

Possible: Set up a discussion forum, using phpBB (latest version, for security) or whatever software you like personally. Set it to require registration, so you can nuke twits who might come in to start trouble.

I say possible here because you might not want the headaches... Discussion forums are rewarding, but they take a certain diligence to keep things useful. The upside is that they allow people to actually become part of the community.

In a local forum, that's a Very Good Thing. Balance this against your own personal tastes and tolerances.

Now, approach various people who are intelligent and opinionated. Offer them a column on your site. (That's what the blogs will be.) Same for local editorialists, music critics, DJs and politicians/civic activists.

Let each one choose whether they want their columns open for posted commentary.

Keep going until you have a good batch of columnists. Make it clear that they're solely responsible for the content of their postings, and that they're expected to maintain reasonable standards. Make it equally clear that you will not attempt to influence their positions.

Now you start offering memberships. Put together a list of things you'll be getting for them. Members-only specials, interviews with interesting local people, commentary from local politicians and more. (Not hard to get, once you build an audience.)

Give them away at first. Set a limit... the first X,000 get in free. At some point after that, you plan to start charging. Note: This is very different from ONLY the first X,000 get in free.

That X,000 is your seed audience. That gets you the ear and eye of a lot of people.

It's also more exposure for ad sales.

Once you've got some good content flowing in, and have some press, then you start charging. Recurring billing, whether monthly (low price, as you can get a lot of local people if the news or entertainment is right), or annually at a moderate price.

Something like this already in your area?

So what? You come at it from a different slant and you're looking for a different audience.

In its never-ending quest to dominate all things animal, vegetable, and mineral (and living or dead) - Google is once again tightening its noose around the skinny neck of the 'searching' world.

Apparently the steroid / LSD / oxycontin cocktails are flowing freely from the Google water cooler again ...

... and the straight jacket is back from the dry cleaners.

According to Jason Miller at WebProNews, Google just filed another patent - this one aimed at so over-analyzing news sources that it will exclude many, many news sources to which we currently have access in the search results we receive from Google.

Personally, I don't trust any of the search engines because they each employ a form of institutional censorship (well - how did you think they got the specific results they show you?).

This is why, when I'm serious about really getting to the bottom of something, I typically use more than one search engine and/or a meta SE like WebFerret, because I want to see the so-called 'opinions' from more than one 'source.'

In other words, every SE provides, in a sense, its own form of propaganda. Why? It only shows us what it wants us to see or the stuff people have paid to have force-fed to us.

You decide.

For some deceived reason, most people see search engines as some sort of benevolent entity sitting gently out in a cyberspace rocking chair somewhere just waiting to serve us perfectly accurate and unbiased content from its musty, dusty set of trusted reference books ... like some sweet old white-bearded, Santa-Claus-looking Granddaddy.

Get real.

Is that really the highest and best use of a search engine if YOU are the SE company?

NO - and we the users of such tools need to fully understand that the SE 'universe' is developing just like the commercial TV business model. Watch the analogies yourself.

The longer we go along, the more search engines become commercial generators instead of relevant content generators.

Do you really trust that business model? Do you believe everything you see on TV?

So I obviously 'noticed' her among the clutter and noise in my inbox.

Can you take a lesson from this (I hope so.)

A few ways to get noticed are to:

  • Send a kind email
  • Etc.
Whatever you do - be sincere ... and be 'you.'

I have been Blessed in my life to have an awesome Father. Dad's soon to be 76 years young. Mom died in 1992, so it's been Dad and me since then.

Not everyone is as fortunate as I am. That saddens me greatly ...

Fathers Hold a Rope of Safety

Many years ago a child was trapped in a hole in the ground. The only way to get him out was to send another child down the tunnel to perform the rescue. A small boy was asked if he would be willing to do it. His response was this: “I am scared to go in that hole, but I will go if my father will hold the rope.”

Life seems to work a whole lot better for the entire world when loving fathers honor their roles and hold secure homes where we can feel loved, safe, and protected. Over the past three or more decades, families have struggled to stay intact.

The women’s movement of the 70’s falsely led many to assume that a father’s role is optional, and not required for a family to succeed. However, research and related statistics tell a different story.

The National Fatherhood Initiative has published these important figures confirming the important role a father plays in the development of a child.

• Fatherless children are twice as likely to drop out of school as their friends who live with two parents.

• Sixty percent of rapists grew up in fatherless homes.

• Seventy-two percent of all teenaged murderers were raised without a dad.

• Seventy percent of kids living in juvenile corrections homes were raised by a single parent.

• Children without a father’s positive influence consistently score lower than average in reading and math tests.

• Three of fourteen suicides occur in single-parent families.

• Eighty percent of the adolescents in psychiatric hospitals come from fatherless homes.

• The absence of a biological father increases a daughter’s vulnerability to rape and sexual abuse by 900 percent (often these assaults are committed by stepfathers or the boyfriends of custodial mothers.)

The truth is, too much of today’s problems stem from a world-wide family living without fathers who are willing and able to hold the rope of love and safety for their children.

Now child poverty, crime, drug abuse, and family decay can be traced to homes where a father wasn’t present, loving, or nurturing. Women play a huge role in creating fathers who are responsible and loving.
Mothers have an obligation to properly care for and nurture their sons so that down the road, they know how to love and care for their children.

General Douglas MacArthur once said, “By profession, I am a soldier and take pride in that fact, but I am prouder, infinitely prouder, to be a father.”

How can we help fathers succeed in their roles?

Religious teacher, James E. Faust makes two simple suggestions:

“First, sustain and respect the father in his position;
second, give him love, understanding, and some appreciation for his efforts.”

'You've got to find what you love,' Jobs says

This is the text of the Commencement address by Steve Jobs, CEO of Apple Computer and of Pixar Animation Studios, delivered on June 12, 2005.

I am honored to be with you today at your commencement from one of the finest universities in the world. I never graduated from college. Truth be told, this is the closest I've ever gotten to a college graduation. Today I want to tell you three stories from my life. That's it. No big deal. Just three stories.

The first story is about connecting the dots.

I dropped out of Reed College after the first 6 months, but then stayed around as a drop-in for another 18 months or so before I really quit. So why did I drop out?

It started before I was born. My biological mother was a young, unwed college graduate student, and she decided to put me up for adoption. She felt very strongly that I should be adopted by college graduates, so everything was all set for me to be adopted at birth by a lawyer and his wife. Except that when I popped out they decided at the last minute that they really wanted a girl. So my parents, who were on a waiting list, got a call in the middle of the night asking: "We have an unexpected baby boy; do you want him?" They said: "Of course." My biological mother later found out that my mother had never graduated from college and that my father had never graduated from high school. She refused to sign the final adoption papers. She only relented a few months later when my parents promised that I would someday go to college.

And 17 years later I did go to college. But I naively chose a college that was almost as expensive as Stanford, and all of my working-class parents' savings were being spent on my college tuition. After six months, I couldn't see the value in it. I had no idea what I wanted to do with my life and no idea how college was going to help me figure it out. And here I was spending all of the money my parents had saved their entire life. So I decided to drop out and trust that it would all work out OK. It was pretty scary at the time, but looking back it was one of the best decisions I ever made. The minute I dropped out I could stop taking the required classes that didn't interest me, and begin dropping in on the ones that looked interesting.

It wasn't all romantic. I didn't have a dorm room, so I slept on the floor in friends' rooms, I returned coke bottles for the 5¢ deposits to buy food with, and I would walk the 7 miles across town every Sunday night to get one good meal a week at the Hare Krishna temple. I loved it. And much of what I stumbled into by following my curiosity and intuition turned out to be priceless later on. Let me give you one example:

Reed College at that time offered perhaps the best calligraphy instruction in the country. Throughout the campus every poster, every label on every drawer, was beautifully hand calligraphed. Because I had dropped out and didn't have to take the normal classes, I decided to take a calligraphy class to learn how to do this. I learned about serif and san serif typefaces, about varying the amount of space between different letter combinations, about what makes great typography great. It was beautiful, historical, artistically subtle in a way that science can't capture, and I found it fascinating.

None of this had even a hope of any practical application in my life. But ten years later, when we were designing the first Macintosh computer, it all came back to me. And we designed it all into the Mac. It was the first computer with beautiful typography. If I had never dropped in on that single course in college, the Mac would have never had multiple typefaces or proportionally spaced fonts. And since Windows just copied the Mac, its likely that no personal computer would have them. If I had never dropped out, I would have never dropped in on this calligraphy class, and personal computers might not have the wonderful typography that they do. Of course it was impossible to connect the dots looking forward when I was in college. But it was very, very clear looking backwards ten years later.

Again, you can't connect the dots looking forward; you can only connect them looking backwards. So you have to trust that the dots will somehow connect in your future. You have to trust in something - your gut, destiny, life, karma, whatever. This approach has never let me down, and it has made all the difference in my life.

My second story is about love and loss.

I was lucky – I found what I loved to do early in life. Woz and I started Apple in my parents garage when I was 20. We worked hard, and in 10 years Apple had grown from just the two of us in a garage into a $2 billion company with over 4000 employees. We had just released our finest creation - the Macintosh - a year earlier, and I had just turned 30. And then I got fired. How can you get fired from a company you started? Well, as Apple grew we hired someone who I thought was very talented to run the company with me, and for the first year or so things went well. But then our visions of the future began to diverge and eventually we had a falling out. When we did, our Board of Directors sided with him. So at 30 I was out. And very publicly out. What had been the focus of my entire adult life was gone, and it was devastating.

I really didn't know what to do for a few months. I felt that I had let the previous generation of entrepreneurs down - that I had dropped the baton as it was being passed to me. I met with David Packard and Bob Noyce and tried to apologize for screwing up so badly. I was a very public failure, and I even thought about running away from the valley. But something slowly began to dawn on me – I still loved what I did. The turn of events at Apple had not changed that one bit. I had been rejected, but I was still in love. And so I decided to start over.

I didn't see it then, but it turned out that getting fired from Apple was the best thing that could have ever happened to me. The heaviness of being successful was replaced by the lightness of being a beginner again, less sure about everything. It freed me to enter one of the most creative periods of my life.

During the next five years, I started a company named NeXT, another company named Pixar, and fell in love with an amazing woman who would become my wife. Pixar went on to create the worlds first computer animated feature film, Toy Story, and is now the most successful animation studio in the world. In a remarkable turn of events, Apple bought NeXT, I retuned to Apple, and the technology we developed at NeXT is at the heart of Apple's current renaissance. And Laurene and I have a wonderful family together.

I'm pretty sure none of this would have happened if I hadn't been fired from Apple. It was awful tasting medicine, but I guess the patient needed it. Sometimes life hits you in the head with a brick. Don't lose faith. I'm convinced that the only thing that kept me going was that I loved what I did. You've got to find what you love. And that is as true for your work as it is for your lovers. Your work is going to fill a large part of your life, and the only way to be truly satisfied is to do what you believe is great work. And the only way to do great work is to love what you do. If you haven't found it yet, keep looking. Don't settle. As with all matters of the heart, you'll know when you find it. And, like any great relationship, it just gets better and better as the years roll on. So keep looking until you find it. Don't settle.

My third story is about death.

When I was 17, I read a quote that went something like: "If you live each day as if it was your last, someday you'll most certainly be right." It made an impression on me, and since then, for the past 33 years, I have looked in the mirror every morning and asked myself: "If today were the last day of my life, would I want to do what I am about to do today?" And whenever the answer has been "No" for too many days in a row, I know I need to change something.

Remembering that I'll be dead soon is the most important tool I've ever encountered to help me make the big choices in life. Because almost everything – all external expectations, all pride, all fear of embarrassment or failure - these things just fall away in the face of death, leaving only what is truly important. Remembering that you are going to die is the best way I know to avoid the trap of thinking you have something to lose. You are already naked. There is no reason not to follow your heart.

About a year ago I was diagnosed with cancer. I had a scan at 7:30 in the morning, and it clearly showed a tumor on my pancreas. I didn't even know what a pancreas was. The doctors told me this was almost certainly a type of cancer that is incurable, and that I should expect to live no longer than three to six months. My doctor advised me to go home and get my affairs in order, which is doctor's code for prepare to die. It means to try to tell your kids everything you thought you'd have the next 10 years to tell them in just a few months. It means to make sure everything is buttoned up so that it will be as easy as possible for your family. It means to say your goodbyes.

I lived with that diagnosis all day. Later that evening I had a biopsy, where they stuck an endoscope down my throat, through my stomach and into my intestines, put a needle into my pancreas and got a few cells from the tumor. I was sedated, but my wife, who was there, told me that when they viewed the cells under a microscope the doctors started crying because it turned out to be a very rare form of pancreatic cancer that is curable with surgery. I had the surgery and I'm fine now.

This was the closest I've been to facing death, and I hope its the closest I get for a few more decades. Having lived through it, I can now say this to you with a bit more certainty than when death was a useful but purely intellectual concept:

No one wants to die. Even people who want to go to heaven don't want to die to get there. And yet death is the destination we all share. No one has ever escaped it. And that is as it should be, because Death is very likely the single best invention of Life. It is Life's change agent. It clears out the old to make way for the new. Right now the new is you, but someday not too long from now, you will gradually become the old and be cleared away. Sorry to be so dramatic, but it is quite true.

Your time is limited, so don't waste it living someone else's life. Don't be trapped by dogma - which is living with the results of other people's thinking. Don't let the noise of other's opinions drown out your own inner voice. And most important, have the courage to follow your heart and intuition. They somehow already know what you truly want to become. Everything else is secondary.

When I was young, there was an amazing publication called The Whole Earth Catalog, which was one of the bibles of my generation. It was created by a fellow named Stewart Brand not far from here in Menlo Park, and he brought it to life with his poetic touch. This was in the late 1960's, before personal computers and desktop publishing, so it was all made with typewriters, scissors, and polaroid cameras. It was sort of like Google in paperback form, 35 years before Google came along: it was idealistic, and overflowing with neat tools and great notions.

Stewart and his team put out several issues of The Whole Earth Catalog, and then when it had run its course, they put out a final issue. It was the mid-1970s, and I was your age. On the back cover of their final issue was a photograph of an early morning country road, the kind you might find yourself hitchhiking on if you were so adventurous. My wonderful daughter Tiffany picked up a couple of items at the grocery store yesterday for me - my deodorant and shaving cream. I had told her the brand names and 'flavors' I wanted.

When she got home, she brought me different brands and flavors than I told her. I didn't really know the best way to handle it. In one sense, I truly appreciated her getting me the products.

In another sense, they were the 'wrong' brands and flavors - brands and flavors I don't use. So I accepted them (graciously?) ... and wondered what I was going to do now. These are not my brands ...

Do you prefer Chevy to Ford?

Nike to NewBalance?

Coke to Pepsi?

Mustard to mayonnaise?

Sweet pickles to dills?

Tommy Bahama to Old Navy?

The point in this exercise is for you to ask yourself if you are preferred by people over your competitors. Do you have top-of-mind awareness when people think of folks in your field?

Do you have brand recognition?

Are you accepted as the obvious expert in your field?

Many of us are not. So don't feel bad.

Just begin today to do something to establish yourself as the go-to-guy or go-to-gal in your field. There are scores of ways to do it. The fastest way is though relationships with others in your field, where you can do joint ventures together.

There's a very wise saying which states, "Let patience have her perfect work."

This simply means that patience is a virtue, paying big dividends to you over time, when you learn to let things happen when they're supposed to, instead of trying to force things to happen.

Another wise saying is "There is a time and a season for everything."

OK - why am I being so philosophical?

In the last 14 days I've been retained in 2 separate, very lucrative consulting contracts. One is with Randy Gilbert as the Executive Producer for his "The Inside Success Radio Network."

The other is as the Affiliate Manager for Jay Abraham and Tony Seruga for Jay's new "Partners In Profit" and "Insiders' Club" programs.

With all due respect to you, the fees and other details are my private business. The point I make here is that wonderful opportunities present themselves over time if you are faithfiul, reliable, honest, consistent, and put integrity above money.

Word gets around.

And frankly, I didn't expect either of these deals to happen, so we can call them 'surprises.'

I've known both Randy and Tony for a couple of years now. I've been with Randy and Tony in person before, but have never met or spoken with Jay Abraham. So how did I get the gig as Jay's Affiliate Manager without ever meeting or talking with him?

An endorsed recommendation from Tony.

How did I get the gig with Randy? Being faithful and reliable over time.

This stuff is basic - it's not rocket science - but so many 'gurus' would have you believe that if you'll just buy their over-priced, over-hyped "how-to-do-JVs" product, like magic you'll be doing huge JVs tomorrow and be filthy rich the next day.

Crap.

Hogwash.

Trust me when I tell you that this group of unscrupulous people will lie to you about something else, too. Do what you know to do. Be who you are. Be to others what you want them to be to you.

Let patience have her perfect work, learn how this stuff REALLY works, and you can look forward to wonderful surprises happening to you over time, too.

Putting people I know, like, and trust together for their mutual benefit thrills me ... it's my passion. I try to create situations where everyone gets exactly what they want, and the deal is fair for ALL the players ...

A win-win as we like to call it.

"When I look back on my life, there are three lessons I've learned, each of which has become solidly hardwired into my psyche.

1 - There never was anything to be afraid of. The opportunities I passed up, the women I never enjoyed, the rock star I never became. All sacrificed at the altar of fear - fear that never really existed.

2 - My worst decisions and actions happened when I was being petty, weak or self-involved. The less-than-kind comments I made about people, the negative outside influences that affected me.

3 - I am on this planet for bigger purposes than accumulating riches. Thirteen years ago my life was permanently, profoundly altered by a dog named Milo. He put me on an entirely different life path.
